Seeing the need for change, the National Association of REALTORS made amendments to it's Code of Ethics. To ensure equal uniform adoption, NJ REALTORS worked along state lawmakers to create the New Jersey Real Estate Consumer Protection Enhancement Act; signed into law on July 10, 2024.

There's now increased transparency in how both listing and buying brokers are compensated.  Sellers still have the choice to offer compensation to buyer brokers. However, how we advertise that compensation has changed. A more complete guide on compensation can be found here.

As of August 17, 2024, offers of compensation are no longer allowed on MLSs. Offers of compensation may still be advertised off-MLS; for example, via social media or email. Offers of concession may be available to market via the MLS, however this is up to the MLS to decide. More MLS info can be found here.

Designated Agency is now a legal agency representation option for sellers and buyers. Designated agency differs from dual agency. In designated agency, the seller and buyer may still be represented by the agents from the same brokerage, however the brokerage assigns one agent to solely represent the seller and one agent to solely represent the buyer. Seller Property Condition Disclosures are now required to be fully completed by every seller, investor or estate. This disclosure must be available for potential buyers to review prior to making an offer. All other previously required documentation is still required as well.
